The short answer
NSW regulates secondary dwellings through the Housing SEPP, which sets a statewide framework rather than leaving it entirely to individual councils. A secondary dwelling can often be approved through a faster Complying Development Certificate (CDC) pathway if it meets set standards; if it does not, it goes through a standard Development Application (DA) with your council instead, which takes longer. Floor area caps and site rules can still vary by zone and by council overlay, so the framework narrows the questions rather than answering them for your specific block.

CDC versus DA, in plain terms
A Complying Development Certificate is a faster approval available when your proposal meets fixed, published standards exactly — size, setbacks, height and so on. If it does not meet every standard, or your land has a constraint the CDC pathway excludes, it goes to a standard Development Application through your council, assessed on merit and generally taking longer. Which pathway you qualify for is worth confirming before you finalise a design, not after.
What decides the numbers on your block
Minimum lot size, zone, and whether your land carries a flood, bushfire, heritage or environmental overlay all affect what a secondary dwelling can be and how it is approved. A figure that applies to a standard suburban lot is not automatically the figure that applies to yours.
One dwelling, one lot, no subdivision
A secondary dwelling sits on the same title as the principal dwelling and cannot be separately subdivided or sold off — it remains legally part of the one property, which is a constant across NSW rather than something that varies by council.
Renting it out
Recent reform has generally widened who a secondary dwelling can be let to, moving away from family-only restrictions in many cases — but confirm the current position for your specific approval before it becomes part of your financial plan for the project.
Building code and energy requirements still apply
A secondary dwelling must meet the National Construction Code regardless of the planning pathway, and current requirements generally call for a high minimum energy rating on new dwellings. Your building certifier or designer confirms what this means in practice for your build.
